A tribunal has thrown out the bullying and discrimination claim brought by a former paralegal against Linklaters.

Ali Hussain joined the firm in 2009. In 2012 he claimed that he had been bullied into working overtime, and had been discriminated against because he was a Muslim. He also alleged that the firm had engaged in fraudulent billing of clients. Linklaters investigated, found nothing amiss and told him to sling his hook.

So Hussain took the firm to court, trying to generate as much publicity as possible by tipping the press off beforehand. Despite the embarrassment Linklaters stuck to its guns, and on Friday the London Central Tribunal found in favour of the firm, Legal Week reports. The judge threw out the claim in its entirety, and held that he had "little confidence in the accuracy of the allegations of fraudulent billing. Ali Hussain was not acting in good faith when he made these allegations".

A spokesman for Linklaters told RollOnFriday that "given the gravity of the allegations, we felt we had to take a stand and are delighted with the tribunal’s unequivocal vindication of our position".

Overbilling is endemic. When I worked for a top 15 firm one of the partners regularly time dumped. We all knew he was doing it as the files were in our rooms and he hadn't worked on them. When a senior associate raised it with another partner the senior associate was told to turn round, walk out of the meeting and never mention it again.

I have yet to work for a partner who hasn't padded his time. Actually, there is one but they've told him to sling his hook...moral of the story kids, if you don't pad and get those utilisation stats up, you're going to be out on your rear. Lord Neuberger talks a lot of sense.
