I think actually the analysis needs to be split between people who need them for functional reasons and people who need them for modesty only. Bras are just upper body pants for some people.
Would it include all bras? Nippleless for example? Or sports bras? Or wonderbras? We could end with am amusing Jaffa cake type debate about whether tan tax position depends n whether it supports or titillates.
The functional/modesty distinction is a fair point. Those deemed to need them for functional reasons could be given a personal discount code, issued by His Majesty's Inspectors of Tits, which they can present at the point of sale to get a VAT free purchase
Although tbf that's a very good reason to establish a discount scheme for individuals based on eligibility through function need. And a good reason to establish His Majesty's Inspectors of Tits (not that a reason is needed).
