Clayton Utz is rumoured to be suing Grant Fuzi, the former partner who led the defection from the firm to Allen & Overy's new Sydney office.
 
Apparently Clutz has called in a top silk for advice. The action is believed to be based on an allegation that Fuzi received a $700,000 payout on his departure from Clutz on the understanding that he wasn't going to a competitor (word is he was to leave law and move to Byron - surf's up dude). Clutz now wants its money back.

A spokesman for Clayton Utz said "to the extent there are matters between the firm and either former partners or current partners, they are confidential matters and we really can't comment any further".

Meanwhile there are rumours that Clutz may shortly be on the receiving end of some litigation itself, from advertising powerhouse WPP. Details are sketchy, but according to The Australian it relates to an alleged conflict which arose when Clayton Utz acted in for WPP on the acquisition of the Communications Group from Pacific Equity Partners. The matter was settled last autumn - WPP even posted a statement on its website. But rumours persist that it's kicked off again.

David Fagan, Clayton Utz's Chief Executive Partner, told RollOnFriday that "the firm is not aware of what claim, if any, may be made against it. If any claim is made we will meet it as and when it is made."
